Liability Waiver and Agreement *

Dynamometer & Tuning Liability Waiver and Agreement PLEASE READ CAREFULLY BEFORE SIGNING I, the undersigned “Customer,” acknowledge and agree to the following: 1. Acknowledgment of Testing Conditions and Risks I understand that all dynamometer and/or street testing will be performed at maximum performance levels, including wide-open throttle. I acknowledge that this places stress on my vehicle similar to or greater than what it would experience during road or track operation. I understand and accept that such testing may result in engine, powertrain, transmission, transfer case, clutch, brake, tire/wheel, or other component failure or damage. I accept full responsibility for any and all damage to my vehicle. I knowingly and voluntarily assume all risks associated with operating my vehicle on the dynamometer and/or during road testing. 2. Vehicle Condition Representation I represent and warrant that: I am fully aware of my vehicle’s condition. My vehicle is in acceptable mechanical condition for dynamometer and/or street testing. All components are in good working order and capable of full power and full-throttle operation. I understand that Bains Tuning has no knowledge of my vehicle’s condition and makes no representations regarding its safety or mechanical fitness. I nevertheless authorize Bains Tuning to proceed with testing and tuning. 3. Tuning Risks and Off-Road Use I acknowledge that: Engine management tuning pushes the mechanical limits of the vehicle. Component failure may occur as a result of tuning. Tuning services are intended strictly for off-road use. Bains Tuning is not responsible for any emissions-related issues arising from tuning. I agree that any damage incurred before, during, or after testing/tuning is solely my responsibility and not the fault of Bains Tuning. I further understand that situations beyond the control of the tuner may arise during the tuning process. 4. Waiver and Release of Liability I voluntarily release and forever discharge Bains Tuning, its owners, employees, officers, directors, and representatives from any and all claims, demands, actions, or causes of action—whether in law or equity—arising from: Road testing Dynamometer testing Tuning services Mechanical services Bodily injury Death Property damage or loss (known or unknown) This release includes claims related to first aid, medical treatment, or emergency services rendered during testing or tuning. I expressly waive any and all claims against Bains Tuning related to dyno or street testing. 5. Fees and Payment Terms If tuning cannot be completed due to mechanical failure or part incompatibility, at least 50% of the tuning fee is due. The remaining balance is at the discretion of Bains Tuning. Flat-rate tuning fees do not include mechanical diagnosis or repair. Mechanical work required during tuning will be billed at $150 per hour. Typical session times: 1–2 hours: Single map 2–3 hours: Dual map or flex fuel If additional time is required, dyno rental is billed at $150 per hour, and tuning time at $150 per hour. 6. Mechanical Failure & Cleaning Fees In the event of vehicular mechanical failure resulting in fluid discharge or contamination (e.g., oil spill, blown coolant hose), I agree to pay a cleaning/maintenance fee of $500–$1,000. 7. Damage to Equipment I agree to pay in full for any damage caused to the dynamometer equipment during testing. 8. Deposits and Cancellations My deposit reserves a specific time slot/date. If I cancel and my appointment time cannot be filled, my deposit will be forfeited. 9. Authorization to Operate Vehicle By signing this agreement, I authorize Bains Tuning and its employees to operate my vehicle on: The dynamometer Public streets and highways Any location necessary for testing and tuning purposes Bains Tuning reserves the right to decline or discontinue services at any time for any reason. Final Acknowledgment By signing below, I: Confirm that I have read and understood this agreement in full. Accept all risks associated with dynamometer and/or street tuning. Assume full responsibility for my vehicle and any resulting damage. Release Bains Tuning and the dynamometer operator from any and all liability.
